Terms of Service

The services provided by Guardex include, but are not limited to, Guardex.io, the technology and platform integrated therein, our application programming interfaces (APIs) and related applications or products (collectively, the "Service").

1. Applications and Modifications
1.1 By accessing or using the Service, you acknowledge that you understand and agree to be bound by these Terms.
1.2 We reserve the right to modify these Terms in our sole discretion.

2. Services
2.1 Service Description:
2.2 Select the digital currency you wish to exchange and the digital currency you wish to receive (collectively, the "crypto pair").
2.3 Specify the destination address where the received amount will be sent.

3. Terms of Service and Legal Liability
3.1 By using the service, you warrant that:
3.2 You use our services at your choice, discretion and at your own risk;
3.3 You understand that Guardex does not operate in prohibited jurisdictions and reserves the right to choose the markets and jurisdictions in which to operate.
3.4 The Service is not intended for use by persons who are citizens or residents of the United States, Cuba, Iran, North Korea, St. Kitts and Nevis or Syria.
3.5 You are at least 18 years of age or other legal age in accordance with your respective jurisdiction.
3.6 You agree to pay fees for transactions made through the Service as determined by Guardex, which we may change over time.
3.7 You agree to accept the risks associated with the Internet System and the Blockchain Protocol.

4. Additional Provisions:
4.1 The user must be a valid owner of the digital currency, sending address and destination address for each transaction. The service is intended for personal use only.
4.2 The sending and destination addresses and digital currency used or exchanged on these services must not be associated with terrorism, fraud, deception or any type of illegal activity.

4.1.1 Risk and Fees:
4.1.2 Guardex does not provide storage services, which means that digital currencies are not stored as part of user transactions. Users release Guardex from liability for any loss or damage resulting from the use of the Service.

4.2.1 Risk Management:
4.2.2 Guardex.io utilizes an automated risk management system to review all transactions. We reserve the right to freeze your exchange transaction to complete a risk management investigation.

6. AML/KYC Policy
6.1 By accepting these Terms of Service, you agree to undergo the AML/KYC process, which may be applied to you or may be requested by Guardex at any time.
6.2 As part of the AML/KYC procedure, Guardex reserves the right to request any government document valid in your country for identification purposes and to obtain additional information on the origin of the funds, including supporting documents.
6.3 In certain cases (e.g. to confirm your identity as part of the AML/KYC procedure), we reserve the right to freeze your exchange transaction for any period of time necessary to complete the investigation and AML/KYC procedure.
6.4 During the period of the investigation and AML/KYC procedure, Guardex reserves the right to move frozen funds to cold storage for safekeeping.
6.5 If you refuse to undergo the AML/KYC procedure or fail to provide Guardex with requested documents and information, Guardex has the right to refuse your transactions (current and future).
6.6 You warrant that you have provided reliable, accurate, current and complete information and take full responsibility for its accuracy, completeness and validity.
6.7 The time limit for KYC verification is 3 days. You may refuse to undergo the procedure, in which case the amount will be refunded to you, except in certain cases (if the transaction is suspected to be related to any illegal activity).
